Section 21
Operation and Regulation of Health Institutions
: (1) The structure of the health institutions and the arrangements related to the services provided by the institutions shall be as prescribed by the Ministry.
(2) The minimum standards related to health institutions and services shall be as determined by the Ministry.
(3) Every health institution shall provide services subject to the criteria as per sub-section (2).
(4) The health institutions established and operating before the commencement of this Act shall meet the criteria specified in subsection (2) within the time specified by the Ministry.
(5) Union, state and local levels can make necessary partnerships with private or non-governmental health organizations for the delivery of health services.
(6) The government of Nepal may determine the standards, licenses and regulation of services provided by private and non-governmental, private or cooperative or non-profit or community health organizations by publishing a notice in the Nepal Gazette.
(7) According to the criteria determined in accordance with sub-section (6), the federation, the relevant province or the local level may grant a license to operate a health institution.
(8) In accordance with sub-section (7), the arrangements related to granting, renewing and monitoring, evaluating and regulating health institutions from the provincial and local levels shall be in accordance with the respective provincial and local laws.
(9) Notwithstanding anything contained in sub-section (8), the provincial and local levels may license, renew, monitor or regulate health institutions in accordance with this Act until such time as provincial or local laws are enacted.
